§ 1. [PREAMBLE]

We respect and protect the privacy and security of our website users ("Users"). This privacy policy (the "Privacy Policy") applies to data provided to us through the factoryprice.eu website operated at https://factoryprice.eu (the "Website"). In the Privacy Policy, we describe the data that we collect in connection with the provision of electronic services, including e-commerce (the "Services" or the "Service"), as well as the purpose of their collection and the manner of their use. The term "data processing" as used in the Privacy Policy refers to information provided voluntarily by Users, as well as information collected automatically (through so-called "cookies"), and includes all operations on personal data, in particular the collection, recording, storage, development, modification, sharing and deletion, performed in connection with the provision of the Website and the Services.

 

§ 2. [DATA CONTROL]

The Controller of personal data provided by the Users visiting the Website and by the self-employed persons using the Website services, as well as persons representing legal entities using the Website (hereinafter: “Users” or “you”) is Sławomir Pazio conducting business under the name “MUS Sławomir Pazio” in Łazy, ul. Przyszłości 21, 05-552 Łazy NIP: 5210401334, REGON: 010551560 (hereinafter: the "Controller” or “we”), who processes these personal data in accordance with applicable laws, including the Regulation of the European Parliament (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation (hereinafter referred to as: the “GDPR”).

3. You are not obliged to provide the Controller with their personal data. However, your refusal to provide data necessary for the provision of Services shall result in a justified Controller’s inability to provide the Services, and may restrict the your access to the Website or its particular functionalities.

 

§ 3. [PURPOSES OF DATA PROCESSING]

1. We process Users' personal data for the following purposes:

a. Provision of electronic services consisting in making available the content of the Website, maintenance and operation of the User's account, as well as provision of other services available on the Website (e.g. placing orders, tracking the status of orders placed, orders processing by the Controller, etc.). The legal basis for such processing of personal data is the necessity to process them for the performance of the contract concluded with the data subject (Article 6(1)(b) of the GDPR) and the consent of the data subject (Article 6(1)(a) of the GDPR) in the case of data provided on an optional basis;

b. Analytical and statistical purposes, including through profiling. The legal basis for such processing of personal data is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR), consisting primarily in conducting analyses of the activity of the Website Users, the way they use their accounts, or their preferences, in order for the Controller to improve the solutions used in the Website;

c. establishment, exercise or defence of legal claims. The legal basis for such data processing is the Controller's legitimate interest (Article 6(1)(f) of the GDPR) in the form of exercising the protection of the Controller's rights.

2. We provide the possibility of contacting us via electronic contact forms. To use of the form you must provide your personal data necessary to contact you and respond to your query, and these data are processed:

a. for the purpose of identifying the sender and handling his/her query sent via the form - the legal basis for the processing is the necessity to process data for the performance of the services contract (Article 6(1)(b) of the GDPR); with regard to the data provided optionally, the legal basis for the processing is consent (Article 6(1)(a) of the GDPR);

b.Send a newsletter or other form of direct marketing to the User, which may contain commercial information material. The legal basis for such processing of personal data is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR) in connection with the request to send commercial information to the channel chosen by the User (email, sms, mms).

3. Users’ data are also processed for marketing purposes, in order to:

a. Carry out marketing (remarketing) activities, including contextual advertising, i.e. displaying marketing content on the Website not adapted to the User's preferences. The legal basis for such processing of personal data is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR);

b. kierowania do Użytkownika newslettera lub innej formy marketingu bezpośredniego, w którego treści mogą być zawarte materiały stanowiące informację handlową. 4. We processes personal data of Users visiting our profiles on social media (Facebook, YouTube, Twitter, LinkedIn). These data are processed exclusively in connection with the running of the profile, inter alia for the purpose of informing Users about our activities and promoting various events, services and products. The legal basis for processing the personal data for this purpose is our legitimate interest (Article 6(1)(f) of the GDPR) in promoting our own brand.

 

§ 4. [DATA SECURITY]

1. We carry out a risk analysis on an ongoing basis in order to ensure that Users' personal data are processed in a secure manner - ensuring, above all, that only authorised persons have access to the data and only to the extent necessary for the performance of their tasks and that the security measures are adequate to the level of risk to the Users' privacy.

2. We shall take all necessary measures to ensure that also our subcontractors and other cooperating entities provide guarantees to apply appropriate security measures whenever they process personal data on our behalf.

3. User registration and authorisation processes are supported by a secure SSL 3.0 RSA 128bit protocol - guaranteed by a certificate from the Universal Certification Centre operated by Unizeto Technologies S.A. with its registered office in Szczecin - as a result of which Users' personal data are encrypted and - even in the case of transmission interception - impossible to be read by unauthorised persons.

 

§ 5. [ENTRUSTING OF PERSONAL DATA PROCESSING]

1. We undertake to provide you with access to up-to-date information about the entity to which we entrust data processing, about their scope and date of transfer. We shall disclose Users’ personal data by entrusting their processing, in particular to IT solutions providers, including hosting providers, providers responsible for the operation of IT systems, analytical service providers, marketing agencies (for marketing services), as well as logistics operators and courier and shipping companies - exclusively in relation to services that we provide to Users.

 

§ 6. [ODBIORCY DANYCH]

1. Data collected and processed by us may be disclosed to third parties in accordance with this Privacy Policy and applicable law if such disclosure is deemed necessary for:

a. protecting our rights or third-party rights;

b. public security or security of other persons;

c. preventing or stopping actions of an unethical or offensive nature; and in any other cases required by law, in particular in cases of suspicion of committing a criminal act or infringement of intellectual or industrial property rights.

2. Subject to subsection 1, we shall not transfer, sell or make available Users' personal data to other persons or institutions, except with the express consent of the User.

3. We reserve the right to disclose to companies and websites cooperating with us aggregate statistical summaries related to Users.

 

§ 7. [TECHNICAL ISSUES, DATA DELETION, RETENTION]

1. When you browse the Website, our servers automatically collect information sent by your browser and contained in system logs. 1. We use "cookies" text files. “Cookie" is a small piece of information placed at the request of our server (first-party cookies) on the User's telecommunications end device (e.g. computer, smartphone, etc.) when visiting the Website, which the server can read when reconnecting from that device. The use of cookies is aimed to ensure the correct operation of the Website on Users’ telecommunications end devices; this mechanism does not cause any configuration changes in the Users' devices or in the software installed on these devices.

§ 9 [ANALYTICAL AND MARKETING TOOLS]

1. We and our partners apply various solutions and tools for analytical and marketing purposes, inter alia in connection with targeting Users with behavioural advertising on external websites. Please find below basic information about the tools we use. Please refer to the privacy policy of the respective partner for further details.

a. GOOGLE ANALYTICS: We use the analytical tools Google Analytics, which collect information about Users' visits to the website (e.g. sub-pages viewed, time spent on the website, transitions between sub-pages). Google Analytics cookies from Google LLC are used for this purpose. Google Analytics cookies are files used by Google to analyse User’s use of the Website, to compile statistics and reports on the functioning of the Website. Google does not use the data collected to identify the User, nor does it combine this information to enable identification.
